By The Mark LLC ("By The Mark," "we," "us") respects your privacy. This policy explains what information we collect, why we collect it, and what we do with it. It applies to this website and to our services.
Information we collect
- Information you give us. Your name, business name, email address, phone number, mailing or billing address, and anything else you include when you contact us, request a quote, or engage us for work.
- Billing information. Invoice records, amounts, and payment status. Payments are handled by our payment processor. We receive confirmation of payment and limited details such as the last four digits of a card and its expiration date. We do not receive or store full payment card numbers.
- Client project materials. Content, files, credentials, and account access you provide so we can perform the work. We treat these as confidential under our Terms of Service.
- Technical information. Standard server and log information such as IP address, browser type, referring page, and the pages visited, collected automatically by our hosting provider for security and performance.
How we use it
We use this information to respond to inquiries, prepare quotes, perform contracted services, issue and collect invoices, keep required business and tax records, maintain the security of our systems, and comply with the law. We do not sell your personal information, and we do not share it for cross context behavioral advertising.
Who we share it with
We share information only with service providers who need it to support our business, and only for that purpose. These currently include:
- Stripe, Inc. for payment processing and invoicing. Stripe's handling of your information is governed by its own privacy policy.
- Hosting, email, and storage providers used to operate this website and run our business.
- Our accountant and, where necessary, legal counsel, in connection with financial reporting and compliance.
- Subcontractors engaged on your project, who are bound to confidentiality obligations.
We may also disclose information if required by law, subpoena, or other legal process, or to protect our rights, safety, or property.
Cookies and analytics
This website does not set advertising or tracking cookies. Our hosting provider may set strictly necessary cookies and collect anonymous aggregate traffic data to operate and secure the site. If we add analytics in the future, we will update this policy before doing so.
How long we keep it
We keep inquiry correspondence for up to two (2) years. We keep contracts, invoices, and financial records for at least seven (7) years to meet tax and legal requirements. Client project materials are retained for the duration of the engagement and for a reasonable period afterward so we can support the work, then deleted on request.
Security
We use reasonable administrative and technical safeguards to protect information in our care, including access controls and encrypted storage and transmission where appropriate. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Your choices and rights
You may ask us to access, correct, or delete the personal information we hold about you, subject to records we are required to keep. You may opt out of non essential email from us at any time. Texas residents and residents of other states with applicable privacy laws may have additional rights, including the right to know what information we collect and to request its deletion. To exercise any of these, email us at the address below. We will respond within forty five (45) days.
Children
Our services are directed to businesses and organizations, not to children. We do not knowingly collect personal information from anyone under thirteen (13) years of age.
Changes to this policy
We may update this policy from time to time. The current version and its effective date are always posted on this page. Material changes will be reflected in a revised effective date.
